Duke Power Company Quality Assurance Requirements for Transport Packages
Dear Mr. MacDonald:
On August 4, 1977 the Nuclear Regulatory Cocmission published in the Federal Register (42 FR 39364) an amendment to the regulations in 10CFR Part 71 to upgrade requirements for quality assurance asso-ciated with transport packages. The effective date of these regula-tions was October 18, 1977 and Paragraph 71.51(a) required that a description of the quality assurance program established pursuant to the amended regulations be filed by July 1, 1978.

- raph 71.51(d) of the amended regulation, however, stated that a uommis-sion-approved quality assurance program which satisfies the applicable criteria of Appendix B to 10CFR Part 50, and which is established, main-tained and executed with regard to transport packages shall be deemed to satisfy the requirements of Paragraph 71.51(a).
Duke Power Company has a Commission-approved quality assurance program which satisfies Appendix B to 10CFR Part 50, as described in Duke Power Company Topical Report DUKE-1-A " Quality Assurance Program." Pursuant to the August 4,1977 amendments to 10CFR Part 71, this program was applied for Oconee Nuclear Station (Facility Operating Licenses DPR-38, -47 and -55) effective October 18, 1977 to packages / containers for offsite shipment of fissile material and quantities of licensed material in excess of Type A quantities. The quality assurance program has similarly been applied for McGuire Nuclear Station (Docket Numbers 50-369 and -370) and Catawba Nuclear Station (Docket Numbers 50-413 and
-414), and will be applied to future Duke nuclear stations, for activ-les licensed by the NRC.
