Dear Mr. Miller:
This is to confirm our telephone conversation of this date in which; pursuant to 10 CFR 52.711(a), you approved the stipulation entered into between the NRC Staff and Pacific Gas and Electric Company (PG&E) granting the Staff an Extension of Time in Which to File A Motion to Compel Re-sources to the Staff's First Set of Supplemental Interrogatories directed to PG&E.
As you will recall, at the last Prehearing Conference (January 23-25),
the Staff and PG&E agreed that PG&E would have until April 4 in which to file its responses to the Staff's First Set of Supplemental Interrogatories, as served on December 15, 1978.
The first responses under those interrog-atorics were received by the Staff on February 5.
Detailed attachments and further responses are expected prior to the April 4 deadline agreed upon by the parties.
Since the Commission's Rules of Practice specify a 10 day period in which to file a Motion to Compel, the Staff contacted PG&E for the instant extension on February 6.
Pursuant to this stipulation, the Staff will have until april 30 in which to file any Motions to Compel which it may feel necessary. As I dis-cussed with you by telephone, the Staff does not necessarily believe such a Motion will be required, but is acting to preserve its rights under the Rules of Practice.
If such a Motion becomes necessary, the agreed-upon April 30 date will allow agruments to be heard at the next scheduled Prehearing Conference on May 15.
All parties have been informed by telephone of this stipulation and have stated no objections.
