fiRC STAFF RESP 0:!SE T0 flRDC REQUEST FOR EXTE::SIO*: OF TI"E TO FILE At: APPEAL On January 29, 1979 ffatural Rtsources Defense Council ':RDC) filed a request for an extension of time in which to file an appeal from a Licensing Board Order dated January 9,1979 denying tiRDC's petition to intervene and a subsequent order rejecting flRDC's objections to the denial.1I The NRC Staff does not object to affording fiRDC some addi-tional time in which to brief the issue on appeal. The NRC Staff does object to NRDC's proposal to establish such a time based on an antici-pated ruling by another Licensing Board in a different docket.
1/ The Licensing Board's Order rejecting f1RDC's objections had not been issued as of the date of f1RDC's request.
The Licensing Board issued such an order on February 2,1979.

a Arniicant took this risk on taenselves by rai ing the is ue in ne first instance and cannot now be heard to complain that they t.:uld be disadvan-taged by an adverse decision requiring a new beginning to the currently ongoing licensing proceedings.
TIRDC's argument must be rejected because it flies in the face of the very rationale allowing interlocutory appeals from an order denying an inter-vention in the entirety, viz that a prompt review may be had so that no party would be prejudiced by delay in determining the parties to the proceeding.
If equity and f.airness could be assured by an indefinite delay in ruling on such a petition no reason would exist for permitting interlocutory review of Licensing Board decisions denying intervention petitions in their entirety.
It is also noted that NRDC has briefed this issue before the Licensing Board and in filing objections to the Board's Order and thus has had time to fully font.ulate its position.
