(7.81213N MEMORANDUM TO THE FILE STAFF C0flCLUSIONS REGARDING LICENSE TO EXP0RT NUCLEAR EQUIPMENT TO SPAIN (XCOM0119)

In November 1978, Babcock & Wilcox Company applied for a license to export to Spain specially designed components to replace damaged parts in the Lemoniz No. 1 nuclear reactor.

In a letter dated February 07, 1979,the State Department informed the NRC that it is the view of the Executive Branch that this proposed export to Spain meets the three export license criteria of 6110.42(b) of Part 110 for the export of nuclear equipment. The three criteria of 5110.42(b), (1) application of IAEA safeguards to the equipment, (2) no nuclear explosive use of equipment, and (3) no retransfer of the equipment without prior U.S. approval, are met by Spain as confirmed in a letter to the U.S. Embassy in Madrid dated January 19, 1979 from the Ministry of Energy and Mineral Resources.

As. required by Section 109(b) of the Atomic Energy Act and 5110.44(a)

(1)(ii) of Part 110, the staff has concluded that the proposed export would not be inimical to the common defense and security of the United. States or constitute an unreasonable risk to public health and safety.
