s ORDER CONCERNING INIERROGATORIES, TER4INATION f

DISCGTERY, AND SCHEDULE (April 12,1979)

I.

On March 6,1979, the Staff filed written interrogatories to be answered by Intervenor Carolina Envirottnental Study Group (CESG) in accord-ance with the provisions of 10 CFR 52.740. Written responses under oath or affirmation were due on March 26,1979 (10 CFR SS2.740b(b) and 2.710). The Board entered an Order on February 23, 1979 directing the parties to proceed expeditiously with discovery.

The Staff's interrogatories are within the scope of permissible discovery of a party, and are based on the contentions advanced by CESG.

The failure of the latter to make complete and nonevasive responses is not excusable. The Staff's motion is granted, and CESG is ordered to respond fully to the Staff's interrogatories within five (5) days from the service of this Order. The parties are cautioned that failure to comply with orders or Rules of Practice of the Conmission may result in their dismissal from the proceedings.

The Staff also filed written interrogatories on_the Davidson College Chapter of the North Carolina Public Interest Research Group (PIRG) on March 6, 1979, and responses were due on March 26, 1979. No responses have been made by PIRG. For the reasons set 'forth above, the Staff,'s motion to ccmpel responses is granted. PIRG is ordered to respond directly and fully to the Staff's interrogatories within five (5) days from service of this Order, or to be subject to dismissal from the proceedirg,.

Interrogatories were filed by the Staff on Carolina Action on March 6, 1979 and responses were due on March 26, 1979. No responses or answers have been made by Carolina Action. For the reasons discussed above, the Staff's motion to compel responses is granted.

Carolina Action is ordered to respond fully and nonevasively to the Staff's interrogatories within five (5) days fran service of this Order, under penalty of dismissal fran the proceeding.

The following schedule is hereby adopted to govern the con 61ct of this proceeding:

May 4, 1979 Motions for sumury disposition filed.

May 31, 1979 Discovery closed.
