PROPOSED LICENSE TO IMPORT ENRICHED (fRANIUM FROM JAPAN (LICENSE APPLICATION ISNM79007)
Purpose:
Commission review of proposed issuance of import license to Edlow International Company, as agent for British Nuclear Fuels, Ltd.
Review Dates:

, Discussion:
On February 7, 1979 Edlow International Company, as agent for British Nuclear Fuels, Ltd., (which is managing the transport on behalf of the Japan Atomic Energy Research Institute) requested a license to import up to 115 kilograms of uranium containing 98 kilograms of U-235 and 240 grams of plutonium from Japan.
The material is in the form of 405 irradiated JMTR fuel assemblies and 80 irradiated JRR-2 and JRR-4 fuel assemblies being returned to the U.S. for reprocessing under Department of Energy contract EY-76-C-09-1031.
The irradiated fuel elements will be shipped in casks W aring certificate of compliance numbers USA /0104/B()F and USA /6393/B(M)F. These casks are approved for the shipment of the type of material involved.
A total of five shipmt.nts are planned at six month intervals beginning in September 1979 and ending by January 1, 1982. The material meets the conditions of 10 CFR 73.6(b) with respect to separability and radiation levels and, therefore, is exempt from the
-m transportation security requirements of Part 73.

. The import of irradiated MTR-type fuels has been the subject of Commission review on a number of occasions in the past; for example, under licenses ISNM01737 (SECY-78-222 and SECY-78-222A), ISNM01780 (SECY-78-ll4),
and ISNM01793 (SECY-78-94).
Staff views and comments for those previous cases are applicable, also, to the case at hand and the staff finds that this proposed. import conforms with the provisions which have governed shipments of such material, that it will not be inimical to the common defense and security, will not constitute an unreasonable risk.to the health and. safety of the public and will involve no significant environmental impact.
The fellowing documents are forwarded for Commission review of the subject application: (1) application of February 7, 1979 at Appendix A and (2) copy of proposed license at Appendix B.
NMSS Technical Review:
NMSS notes that the application doos not identify the destination of any su0 sequent export. Accordingly, it is impossible at this time to provide any information concerning the adequacy of safeguards to be applied to this material upon any subsequent export.
OIP Comments:.With respect to the possible reexport of material involved here, IP notes that, if this occurs, it will be the subject of separate Executive Branch and NRC reviews of statutory requirements, including the safeguards aspects. The applicant is aware that license authority for an import does not imply that a proposed subsequent export will be approved.
Recommendation:
That the proposed import license be issued to Edlow International Company.

Because the ultimate destination of the material is unknown, NMSS is unable to ascertain whether there are any foreign physical security or IAEA safeguards issues associated with this import. OELD has no legal objection.
