g Appendix A NOTICE OF VIOLATION P

Republic Industries, Inc.

License No. 12-15641-02E Based on the inspection conducted on April 4, 1979, it appears that certain of your activities were in noncompliance with NRC require-ments, as noted below.

This item is an infraction.

Paragraph 10 CFR 30.3, Activities Requiring Licensing, Title 10 of the Code of Federal Regulations, Part 30, requires, in part, that no person shall manufacture, produce, transfer, receive, acquire, own, possess, or use, byproduct material except as authorized in a specific or general license issued pursuant to the regulations in this part.

Contrary to this requirement, from May 5, 1978, up to the date of this inspection the licensee was receiving by import from Japan, americium-241 contained in smoke detector components identified as Model No. SD-48, and assembling these with another component to produce an integral product, the DFE III Combined Holder / Closer /

Detector, for distribution as an exempt item for use to close fire doors and for smoke detection.

In addition, the finished product was being tested by the licensee.

This utilization of americium-241 is not authorized.
