Dear Mr. Gridley:
I am responding to your letter of January 30, 1979, regarding " Application of 10 CFR 50.59 to :GE Reload Fuel."
According to 10 CFR 50.59, if a reload does not involve either a technical specification change or an unreviewed safety question, the prior approval of the NRC is not required. Thus, it is desireable to so establish technical specifications that changes are not necessary at refueling.
The concept of gaining approval for technical specification changes before actually required and apart from a given reload strikes me as prudent licensing management and in keeping with D0R's wish to reduce its critical-path involvement with reloads. There should be no question that "before need" (to borrow a phrase from another industry) amendment proposals will receive priority consideration by DOR. Reviewing and approving such amendments in a timely fashicn serves DOR's purpose as directly as the utilities'.
