FACILITY ATTACHMENT INFORMATION Purcose:
To transmit recent Facility Attachment informatien from the State Cepartment for facilities which have recently received or may socn receive U.S. nuclear material exports and to respond to requests for such informaticn frem Ccmmissioners Bradford and Ahearne.
Discussion:
Commissioner Bradford's concurrence in three recent expert licenses (XSNM-1104,1149, and 1227) was conditicnal ucon the existence or completion of the relevant Facility Attachments.
In addition, Ccmmissioner Ahearne's concurrenca in a pending export to Taiwan (XSNM-1279) was conditional on ccmpletien of the Facility Attachment.
At the time IP prepared analyses of these cases we did not have infor ation regarding Facility Attachments for all the facilities involved in these cases.
The State Department recently provided IP with additional Facility Attachment information.(February 23 letter from Lou Nosenzo, Enclosure A).
This information is as folicws:
XSNM-1104 AVR-HTR Reactor (FRG) - Facility Attachment is under negotiation; the IAEA is aoplying interim safeguards prior to ccmpletion of the Facility Attachment.
HOBEG Fuel Fabrication and Conversicn Plant (FRG) -
Facility Attachment comoleted February 1,1979.

Facility Attachment completed February 1,1979.
XSNM-ll49 HFR Research Reactor Petten (The Netherlands) -
The Facility Attachment is under negotiation; the IAEA is applying interim safeguards prior to ccm-pletion of the Facility Attachment.
XSNM-1227 KXL Reactor (Switzerland) - Pending initiation of negotiations, the IAEA will apply interim safeguards if material arrives at the facility orior to the completion of the Facility Attachment.
XSNM-1279 WBRL Water Boiler Research Reactor (Taiwan) -
No safeguard actions have been taken in view of facility ccmpletion date.
This statement regarding the status of the WBRL Research Reactor does not agree with previcus information to the effect that construction of this reactor has been completed.
We have written to State (Enclosure B) requesting clarification of the current status of this facility.
Other facilities are also involved in the first two of these exports. The HOR Reactor, which is the end-use consignee for XSNM-1104, has a Facility Attachment in place (1978 State cable Vienna 7261).
Two French facilities (CERCA for XSNM-1104 and 1149, and Cadarache for XSNM-ll49) involved in these cases do not have Facility Attachments.
Since France is a nuclear weapons state, its facilities are not subject to Agency safeguards, but France is also implementing a voluntary offer to place certain facilities under Agency safeguards.
We have also recently received a letter frcm State regarding Japanese Facility Attachments (Enclosure C). This letter says that Facility Attachments have been completed and

Table 10 of the IAEA Annual Report for 1977 (which includes all faci ~lities which were operational or nearing completion when the report was prepared).
