Dear Mr. Schmidt:
We have received your March 1 letter on behalf of your client, Mr. David L. Bowers. It is our understanding that you are interested in a " ruling" from the NRC on the effect of a pardon on the security classification of an employee in the Three Mile Island security procedures.
As you know, the Coensission has recently promulgated regulations i
concerning physical security requirements at power reactors (10 CFR 73.55). An essential coas:onent of the licensee's security system required by these regulations is a personnel screening and reliability program for all employees permitted unescorted access to the protected aree. Such a screening program must include a background investigation I
of all personnel.. The. purpose of such a screening program is to reduce the risk of possible malevolent actions by eliminating or reducing access to the plant's protected and/or vital areas by any individual who does not meet the minimum requirements established in the screening program. The implementation of the program is the responsibility of the licensee. Accordingly, initial inquiry relating to the status of your client should be directed to the Metropolitan Edison Company.

The responsibility to establish appropriate acceptance Tdriteria, and the judgement involved in the review and evaluation of an individual's background lies with the licensee, who is held responsible for the security and safety of the plant.
