Dear Mr. Bukaty:
By petition dated May 15, 1979, you requested on behalf of the Kansas Building and Construction Trades Council that the Commission suspend or revoke the construction permit for the Wolf Creek Nuclear Generating Station Unit No. 1 on the basis of alleged construction inadequacies at the facility.
Your petition did not, however, provide factual information which would establish the basis for taking the proposed action.
Accordingly, fcr the reasons stated in the enclosed decision, your petition is denied.
Footnote 3 on Page 2 of 'the Decision recognized that you might be able to provide additional factual information.
Members of the staff of the Commission's Region IV office in Arlington, Texas have been in communication with you on this subject.
Since, as of this date no additional factual infor-mation has been developed, we now consider that aspect a closed issue.
A copy of the decision has been filed with the Secretary of the Commission for its review in accordance with 10 CFR 2.206(c) of the Commission's regulations.
As also provided in 10 CFR 2.206(c), the decision will constitute the final action of the Commission twenty (20) days after the date of issuance, unless the Commission on its own motion institutes review of the decision within that time.
