Dear Members of the Board:
At the hearing March 27, 1979, in the above-referenced proceedi19, the NRC Staff promised to supply those conditions which it felt were necessary conditions on the dismissal of this proceeding relevant to site decommis-sioning and protection of the public health and safety. At a minimum, in keeping with the Commission's duties to protect the public health and safety, any dismissal of this proceeding must be on the following conditions:
- 1) That all waste is buried in accordance with reauirements of the Commission and the license.
- 2) That all structures, equipment and materials not to be transferred to the custodial agency have been dismantled, decontaminated, if necessary, and disposed of.
- 3) That institutional arrangements have been made for long-term custodial care by the State of Illinois, that there will be an orderly transition to Illinois, and that organizational and funding mechanisms are in place.
- 4) That gamma radiation from buried wastes does not increase back-ground radiation on the site.
- 5) That the rate of release of radionuclides through ground and surface water pathways are at or below the levels set forth in' 10 CFR Part 20, Appendix B at the site boundary, at or below EPA drinking water limits at the nearest water supply, and a small fraction of the levels set forth in 10 CFR Par t 20, Appendix B through air pathways.

- 6) That all trench bottom elevations are above water table levels taking into account the complete history of seasonal water table fluctuations, and that conditions will be created to prevent contact between ground water and the buried waste.
- 7) That all conditions that caused positive environmental samples in the past, including any evidence of unusual or unexpected rates or levels of radionuclide migration in or with ground-water, are analyzed and corrected.
- 8) That the site is stabilized so as to minimize environmental monitoring requirements for long-term custodial care, including elimination of the need for active water management measures, such as sump and trench pumping, and the treatment of water standing in trenches.
- 9) That conditions for potential for water infiltration of trenches, erosion, loss of site or trench integrity due to such factors as ground water, surface water, wind, subsidence and frost action, are eliminated.
This would include establishment of: (a) passive surface water management systems to drain rain water and snow melt away from burial trenches; (b) grading to prevent slumping or gullying; (c) stabilization of the surface by short rooted grasses, rock, riprap, etc.; (d) stabilization of the trench cap to prevent erosion, settling, or erosion of those caps.
- 10) That the site surface has been sealed with a semi-impenneable cap to reduce surface water infiltration,
- 11) That positive controls are instituted to assure that the decom-missioning plan will not be degraded by chemical wastes.
- 12) That trench markers identifying the size and exact location of each trench and the materials buried therein, are in place, stable, and clearly and permanently marked.
- 13) That complete records of site maintenance and stabilization activities, trench elevations and locations, trench inventories and monitoring data fo'r use during custodial care are compiled and transferred to the agency assuming custodial care.
- 14) That a buffer zone surrounding the site to provide sufficient space to stabilize slopes, incorporate surface water management features, and to assure that the future use of adjoining areas would not compromise trench or site integrity, including those arising from chemical wastes, and provide working space for unexpected mitigating measures in the future, is established and transferred to the custodial agency.
. 15) That provision is made for a secure passive site security system.
- 16) That a surveillance program to assure the objectives of the decommissioning plan have been met, including a ground water monitoring system, is established.
The object of these conditions are to see that radionuclide concentrations in unrestricted areas will be less than maximum permitted concentration limits, that the site does not require regular maintenance, and that the need for surveillance be minimized. We would expect the licensee to submit its methods of meeting these conditions to the Board and the Staff for review prior to their implementation.
