The Cities of Anaheim and Riverside, California (Southern Cities) have roved for an order reinstating the notice of deposition of Ecbert H. Gerdes for May 2,1979 in Washington, D. C.
By our Order of April 5,1979, the deposition of Mr. Gerdes was deferred until the Board could hear fran all

counsel en this question at the prehearl'ng conference scheduled for May 15, 1979. The motion is denied.
Counsel for PGSE and the Southem Cities have nade extensive repre-sentations of fact in their respective cotions, which in sane respects are inconsistent if not in conflict. The Board does not intend to rule en noticns or other matters where the facts are in dispute and are prasented in fragmmtary fashion, whether speaking in notions or via the telephone..
