This is in response to your letter and enclosure dated April 23, 1979, in which you requested a time extension for conducting the activities required by 10 CFR 70.51(e)(3)(ii, We have determined that the granting of your request for an unspecified delay for conducting your next low enriched uranium physical inventory will not adversely affect the common defense and security and is otherwise in the public interest, provided no low enriched uranium processing is initiated until such inventory is conducted. Accordingly, the following license condition is being added to Amendment MPP-1 of your License No. SNM-124, effective immediately:
In lieu of the requirement of 10 CFR 70.51(e)(3)(ii) to conduct a physical inventory for uranium enriched to less than 20 percent on or before April 27, 1979, the licensee shall not initiate any low enriched uranium processing until such an inventory is conducted. The inventory shall be performed no later than five days after the settlement of the existing strike by members of Local Number 3-677 of the Oil, Chemical and Atomic Workers International Union or June 30, 1979, which ever occurs first.
We have determined that the enclosure to your letter dated April 23, 1979 contains information of the type specified in 10 CFR 2.790(d).
Accordingly, pursuant to Section 2.790(d)(1), such information is deemed to Se commercial or financial information within the meaning of 10 CFR 9.5(a)(4) and shall be subject to disclosure only in accordance with the provisions of 10 CFR 9.12.
