This refers to the inspection conducted by Mr. B. B. Dicey and Miss E. Matson of this office on January 31 and February 2, 1979, of activities at the Chicago and Elmhurst offices of Nuclear Pharmacy, Inc. authorized by NRC Byproduct Material License No.

12-18044-01MD and to the discussion of our findings with you at the conclusion of the inspection.

This also refers to the manage-ment enforcement conference held at the Region III office on March 23, 1979, between you and others of your staff and myself and other representatives of my staff to discuss the inspection findings and enforcement considerations with respect to those findings.

The inspection was an examination of activities conducted under your license as they relate to radiation safety and to compliance with the Commission's rules and regulations and with the conditions of your license.

The inspection consisted of a selective examination of procedures and representative records, observations, independent measurements, and interviews with personnel.

During this inspection, certain of your activities appeared to be in noncompliance with NRC requirements, as described in the enclosed Appendix A.

This notice is sent to you pursuant to the provisions of Section 2.201 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations.

Section 2.201 requires you to submit to this office within twenty days of your receipt of this notice 1 written ststement or explanation in reply, including for ear.n item of noncompliance: (1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further non-compliance; and (3) the date when full compliance will be a chieved.

APR 5 G79 Nuclear Pharmacy, Inc. In addition to the need for corrective action regarding the specific noncompliance items described in the enclosure to this letter, we are concerned that your management control system permitted these items of noncompliance to occur.

Consequently, in your reply to this letter, you should describe in particular those actions taken or planned to improve the effectiveness of your management control over NRC licensed activities.

The topics discussed at the management enforcement conference held on March 23, 1979, included the NRC enforcement policy, the items of non-compliance and concerns identified during the inspection and your actions to strengthen your radiation protection program. We feel that this meeting was useful to all participants.

We will gladly discuss any questions you have concerning this inspection.
