Dear Messrs. Curtis and Barnes:
This is in further response. to your letter of December 19,1978, in which you requested, pursuant to the Freedom of Information Act, access to records concerning the Tarapur, India, Atomic Power Station and other matters relating to use of nuclear energy by India.
In letters dated January 4 and January 9,1979, we listed documents which were being made available at the NRC Public Document Room (PDR).
Appendix B, enclosed, lists additional documents subject to your request and the disposition of each. Those marked "R" are being released and made available in the PDR; those marked "H" are being withheld from public disclosure.
The documents marked with (1) in the Exemption column were classified pursuant to Executive Order 11652, and continue to be classified under Executive Order 12065.
They are being withheld from public disclosure purs'uant to exemption (1) of the Freedom of Information Act (5 U.S.C. 552(b)(1)) and 10 CFR 9.5(a)(1) of the Commis-sion's regulations.
Those documents marked with (5) in the Exemption column contain advice, opinions, and recommendations of the staff and are being withheld from public disclosure pursuant to exemption (5) of the Freedom of Information Act (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Ccmmission's regulations.
Pursuant to 10 CFR 9.11 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest.
The persons responsible for the denial of the withheld information are the officials specified in the " Denying Official" column of Appendix B.
As provided in 10 CFR 9.11, the documents denied by Messrs. Dircks and Shea are also denied by the undersigned.
These denials may be appealed to the Executive Director for Operations within 30 days from receipt of this letter.
