Dear Ms. Hooker:
Pursuant to your request during our telephone conversation of February 23, 1979, I am writing this letter to explain the enthod by which you may participate in the Allens Creek proceeding now that your petition for leave to intervene has been denied. The Commission's Rules of Practice provide, in 10 CFR 52.715, for what is referred to as a " limited appearance statement." That is, persons who are not parties to the proceeding may, at the discretion of the presiding officer, present their concerns about the proposed facility either at the evidentiary hearing itself, or at a prehearing conference.
Should you wish to a@lify any of the concerns which ycu have expressed previously in this proceeding, you should be aware that limited appearance statements may be made either orally or in writing. Further, a person making a limited appearance statement may not only state his or her position, but also raise questions which he or she would like answered.
If the questions are relevant to the proceeding, the presiding officer may direct that they be answered by the parties.
I should also note that the presiding officer has considerable discretion with regard to when limited appearance statements may be offered.
Should you decide that you wish to make such a presentation, may I suggest that you write to the Atomic Safety and Licensing Board members to alert them to your desire to do so.
