REQUEST FOR WITHHOLDING INFORMATI0M FROM PUBLIC DISCLOSURE -
CAW-78-70 By your application and affidavit dated September 29, 1978 and December 1, 1976, respectively, you submitted a report entitled, " Westinghouse Reactor Protection System / Engineered Safety Features Actuation System Setpoint Methodology" and requested that it be withheld from public disclosure pursuant to 10 CFR 2.790.
Your reasons for requesting our withholding this information were that the information is of the type customarily held in confidence by Westinghouse and is not available in public sources. Public disclosure of this information concerning design procedures is likely to cause substantial harm to the competitive position of Westinghouse since competitors could utilize this information to assess and justify their own design without commensurate expense. The analyses performed and evaluation represent a considerable amount of highly qualified development effort. Westinghouse expended a substantial amount of money and effort to develop this design and its release to the public would jeopardize their competitive status.
The material submitted is of the same type that was withheld from public disclosure by the Commission on April 1978 on another docket.
We have reviewed your application and material based on the requirements and criteria of 10 CFR 2.790 and have determined that the above-mentioned document contains trade secrets or confidential or proprietary commercial information.
We also have found at this time that the right of the public to be fully apprised as to the bases for and effects of the proposed action does not outweigh the demonstrated concern for protection of your competitive position. Accordingly, we have determined that the information should be withheld from public disclosure.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents.
If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, assure that the consultants have signed the appropriate agreements for handling proprietary data.
If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC.
