Dear Dr. Paperiella:

This is a second response to our items of infraction.

Again the item numbers refer to those listed in Appendix A of your original letter.

Item 2.

The howitzer is currently being stored in the mechanical equipment area in Valders Hall of Science. This is a controlled access area which is not oc-cupied except infrequently by maintenance personnel.

It is also not close to any areas of high concentration of people and was considered acceptable by Mr.

N. E. DuBry during his inspection tour at Luther.

Item 3.

We will not be using the neutron howitzer and thus according to con-dition 10D of our license, this source is not subject to the six-ronth inspec-tions.

Prior to our shipping the two Pu-Be sources from the howitzer we will have the wipe tests done by Mr. E. E. Sobottka at Iowa State University, Ames.

Dear Mr. Davis:

This letter is our response to the infractions and deficiencies reported on our License No. SNM-546 and License No. 14-11738-01.

The response to each infraction carries the same number as the infraction in your Appendix A -

Notice of Violations.

1.

Failure to make laboratory surveys.

BeginningwithNovember1,1978alllaboratoriesinwhichradio3so-topes are to be used are being surveyed using wipe tests which are count-ed in a liquid scintillation counter. The results of these test are being recorded in a Laboratory Survey Log Book. Thus we are as of Novem-ber 1, 1978 in full compliance with this regulation.

2.

Lack of equipment which can detect 0.005 microcuries of radioactive materials for checking our plutonium source.

We are currently in the process of returning this plutonium source to the Department of Energy. As of January 9,1979 we have not received specific instructions concerning the location of the disposal site and method of shipment for this source.

As soon as this return is accom-plished we will be in full compliance with this infraction - hopefully by Marcn 1, 1979.

3.

Failure to test the sealed plutonium source at six-month intervals.

See Response to #2 above.

4.

Failure to house the plutonium source (neutron howitzer) in Room 159, Valders Memorial Hall of Science.

See response to #2 above.

5.

Deficiency in posting " Notice to Employees".

This deficiency is incorrect as stated.

The " Notice to Employees" forms NRC-3 were posted; however, they were not updated with the location of the userbyproducts license and NRC regulations. This has been done and we are in. compliance with this regulation as of November 1, 1978.

If there are additional steps which are needed in order for us to meet the NRC regulation, please let me know.
