November 6, 2019 The Honorable Carolyn B. Maloney Interim Chairwoman, Committee on Oversight and Reform United States House of Representatives Washington, DC 20515-6143

Dear Madam Chairwoman:

The U.S. Nuclear Regulatory Commission (NRC) is republishing all of its Privacy Act system of records notices to modify system of record listings and routine use descriptions to accurately describe and more effectively convey information pertaining to them. These changes meet the requirements codified in the Office of Management and Budget (OMB) Memorandum M-17-12, Preparing for and Responding to a Breach of Personally Identifiable Information, dated January 3, 2017, and to conform to guidance in OMB Circular No. A-108, Federal Agency Responsibilities for Review, Reporting, and Publication under the Privacy Act, dated December 23, 2016.

The NRC proposes a new routine use and revising an existing routine use to authorize the NRC to disclose information when reasonably necessary to respond to a suspected or confirmed breach of an NRC system of records or, as appropriate, to assist another agency in its own response to a suspected or confirmed breach. The NRC is also proposing to rescind nine systems of records that are no longer in use or contain only records that are no longer retrieved by the individuals name or other personal identifier.

In addition, the NRC is proposing to revise one system that is a partial duplicate of OPM/GOVT-1 General Personal Records, and renaming it to describe only the records that would now be contained in the system, revising another system to remove an unnecessary routine use, and revising all non-rescinded NRC system notices to include the full text of each routine use applicable to the system, including those previously described in a Prefatory Statement of General Routine Uses.

Finally, the NRC is renaming one system that is a partial duplicate of the Government-wide system OPM/GOVT-1 (General Personal Records). Specifically, the agency proposes to rename NRC 11 to Reasonable Accommodations Records to accurately describe the records that are not covered by the Government-wide system of records OPM/GOVT-1.

In accordance with the guidance in OMB Circular No. A-108, the NRC is enclosing copies of the narrative statement and proposed system of records notices for a 30-day review period. The agency has also sent copies of these documents to the Chairman of the Committee on Homeland Security and Governmental Affairs of the U.S. Senate and the Administrator of the OMB Office of Information and Regulatory Affairs for a 30-day review period.

If you have any questions about the proposed revisions, please contact Mr. Eugene Dacus, Director of the Office of Congressional Affairs, by telephone at (301) 415-1776 or by e-mail to Eugene.Dacus@nrc.gov.

Sincerely,

/RA K. Steven West Acting for/
