BOARD NOTIFICATION ON ALLEGATION REGARDING MISREPRESENTATION OF S0ILS DATA (BN 84-091)
In accordance v;th the NRC procedures Sr Board Notificaticas, the fcllowing infermation is being provided diractly to the Commission as new information potentially ma.erial and relevant to the Midland 05-0L nearing.
This infor-metion is sppi cable onl" to the Midland Plant, Units 1 and 2.
The appro-priate Boards
.t parties are being informed by copy of this memoranduu.
An allegation regarding misrepresentation of soils data provided to the NRC has recently been received and is being reviewed by the NRC. This matter could be material and relevant to (1) quality assurance / quality control issues before the Board 2nd (2) to intervenor's Motion to Litigate Issues Rai wd by Dow Suit and to Open Discovery on the Dow w :s, currently before the foard.
This matter if being referred to the Office of Investigations for evaluation.
We will further advise the Commission and appropriate parties regarding this matter as soon as our review permits.
