This will acknowledge receipt of your letter dated September 19, 1979, informing us of the steps you have taken to correct the nc,ncompliance identified in our letter dated September 6,1979, and receipt of your check in the amount of
$4,300 in full payment of the related proposed civil penalties.
Two matters in your response were clarified during a teleph.one conversation between Mr. R. A. Paul of our Region III office and Mr.. R. O. Wollan of your staff.
As a result of that conversation, it is our understanding that:
1.
With reference to Items 2a and 2b' in your letter, the University will apply-the time limits specified in 10 CFR 20.103(a) and (b) for determining if air concentrations in the general laboratory are within regulatory requirements and will initiate corrective action if the 40 MPC value is exceeded.
2.
With reference to Item 12 in your letter, we understand that a program has been implemented which requires that authorized user permits will be systematically reviewed to assure such permits are valid and have not expired.
We will examine your corrective action during a future irispection.
