Dear Mr. Goldstein:
Your client, Mr. C. R[ Kapiord, has requested that I write to you explaining the procedures under AEC's rules of practice for intervention in AEC reactor licensing proceedings. Appeantly Mr. Kapford wishes to. file-a petition to intervene with respect to Metropolitan Edison's.3-Mile Island Nuclear Station (Docket.
No.50-289). A-notice of Consideration of Issuance of Facilit;y Operating License and. Notice of Opportunity. for Hearing was published in the Federal. Register on July 7.

As the notice indicates, an individual who wishes to become a party to the 3-Mile Island reactor licensing proceeding must file with the Comission a petition for leave.to interver.e. In order to comply with applicable regulations, such a petition must be filed under oath or affirmation, and must set forth the interest of the petitioner in the proceeding, how that interest may be affected by Comission action, and the contentions of the petitioner in reasonably specific detail. In addition, the petition must be filed on time, which in the 34111e Island proceeding means that it must be mailed, properly stamped and addressed, no later than August 7,1972.
I.have not received as yet a copy of your letter requesting a time extension. -

For your information, the above discussion is based on Sections 2.701 and 2.714 of the Canaission's " Rules of Practice," 10 CFR Part 2, a copy of which is enclosed.
You may wish to note that rule 2.701(a) provides that documents in adjudications (such.as.a. petition. for leave to intervene) may be filed by miling.them to the Secretary, U. S. Atomic Energy Comission, Washington, D. C. - 2tS45, Attention: Chief. Public Proceedings Branch.

2-August 1,1972 H.C.Goldstein The Cocuission's rules provide for another mode of participation -
i.e., participation by way of " limited appearance" pursuant to rula 2.715(a). provided that a hearing is hold in the 3-4111e Island proceeding, you could elect to participate in this sanner as an alternative to intervention.. An individual who is pemitted to make a limited appearance may only make an oral or written statement of his position for the record.
He does not have the rights of a full party to the proceedings; for example, unlike an intervenor (who is a full party), a person making a limited appearance may not cross-examine witnesses.
