Re: Metropolitan Edi son Company,.Tersey Central Powe r.& L Lght Company, and Pennsylvania Electric Company Three Mile Island Nuclear Station, Unit 1 Docket No. S'N289 In :u Mir:
on J uly 7, 1972, the Commicston publiahed a lo t.1en oP Consideration of Issuance of Facility Operat Eng f icenso and Nottce of Opportunity for Hearing in the above-captioned proceeding.
On July 24, 1972, Herbert C. Goldstein, Msq.. wri ting on behalf of a group called " Citizens for a Sarn Environment", requested that a hearing with respect to Thron Mlle Island Nuclear Station, Unit 1, not be held until September or October, 1972.
We understand, based on convernations between the AEC Regulatory Staff and Mr.
- olitaLoin, that the letter is to be treated as a request for ad<litional time in which to file a petition to inter-w n.-
in this proceeding.
Applicants oppose any such ex-t.onnion of time.
The CommI anion 's Rules ol' Practlen,.';2 714( a ),
r.<tuir.- t. hut an untimely petition to intervene be dis-minno.1 unloca there is a showing of good cause.
The Com-
":lonion'n revloed regulations, 37 Fed. Reg. 35127, further
.mphanize the need for such showing.
The ?etter on behalf o r "c i ti.~. ens for a Safe Environment" failt to show cood to, justify a delay in filing a petition to intervene.
. tuar F i rn t., t.hr letter does not even make reference to an in-tent.lon to file a petition to intervene.
It asks only that. the hearing phase of the proceeding not begin until
