LICENSEE'S RESPONSE TO COMMUNICATION FROM COALITION FOR NUCLEAR POWER PLANT POSTPONDENT

This will acknowledge receipt from the Docketing and Service Section on September 10, 1979, of a letter dated September 3,1979, addressed to the Secretary of the Nuclear Regulatory Commission and signed by Frieda Berryhill as Chairman of the Coalition for Nuclear Power Plant Postpone-ment (Petitioner) with an address in Wilmington, Delaware.

The letter petitions the Commission for " full participation in the hearings concerning the re-opening of TMI Unit I."*

To the extent that this letter is intended as a petition to intervene pursuant to Section 2.714 of the Commission's Rules of Practice, Licensee objects tc the petition because it fails

  • It appears that the letter as originally typed referred to TMI II and that Petitioner endeavored to correct this refer-ence by erasure to read TMI I. This reading of the letter is confirmed by the fact that the only hearings scheduled for reopening a TMI unit are those scheduled for '+.e first unit. Docketing and Service has docketed the letter under the TMI-l docket.

to set forth Petitioner's interest in the proceeding or to set forth the specific aspect or aspects of the proceeding in which Petitioner wishes to intervene. In fact, most of the topics briefly enumerated under the heading " Nature of my petition" are outside the scope of the hearing.

Licensee would have no objection to a limited appearance by the Coalition for Nuclear Power Plant Postpone-ment pursuant to Section 2.715 of the Rules of Practice.
