During the current week September 17-21 only one member of the staff is present in the office, and his time is entirely committed to preparation for the upcoming depositions (September 25-28) of HL&P personnel, including one of HL&P's designated expert witnesses.
Furthermore, the Department's lead attorney, Ms. Cyphert, is currently out of the country.
This dispersal of staff, as well as the constant burden of preparing for upcoming depositions, has seriously diminished the time and resources available to the Depart-ment for preparing a response to HL&P's motion.
Accordingly, it is necessary that the Department receive an additional week in order to complete its response to HL&P's motion.
The Department is authorized to state that counsel for HL&P have no objection to the granting of the requested ex tens ion.
WHEREFORE, the Department of Justice, pursuant to 10 C.F.R. S 2.711, respectfully moves for an extension of time up to and including September 26, 1979, in which to respond to the " Motion of Houston Lighting & Power Company to Compel Production by the Department of Justice of Certain Drafts 1185 079
of Testimony Prepared by William E.
Scott," dated September 10, 1979.
