Dear Mr. Hawkins:

Enclosed is a copy of proposed amendments to the U.S. Nuclear Regulatory Commission's regulations 10 CFR 30, 40, 70,150, and 170 which were published in the Federal Register on August 24, 1979 (44 FR 50015).

As stated in the notice, the proposed amendments would incorporate into the Commission's regulations new licensing requirements for uranium and thorium mills and their tailings or wastes (i.e., " byproduct material" as defined in the Uranium Mill Tailings Radiation Control Act of 1978). The proposed amendments were derived from a draft generic environmental impact statement issued by the NRC in April 1979, and the requirements contained in the U anium 11111 Tailings Radiation Control Act of 1978 (UMTRCA).

As also stated in the notice, the UMTRCA requires the Ccmmission to ensure that the management of byproduct material, "confonis to general requirements established by the Commission, with the concurrence of the Administrator, which are, to the maximum extent practicable, at least comparable to requife-ments applicable to the possession, transfer, and disposal of similar hazardous material regulated by the Administrator under the Solid Waste Disposal Act, as amended."

The notice further states that the Administrator of EPA will be specifica11y requested to provide comments and recommendations on the proposed amendments to ensure comparability with the requirements established by EPA under the mandates nf the Solid Waste Disposal Act.

It is my understanding, based on NRC and EPA staff discussions, that your Office of Radiation Programs has the lead for EPA's responsibilities under Sections 84 and 275 of the Atomic Energy Act, as amended by the UMTRCA. Accordingly, 7910020 2
