Under the Nuclear Non-Proliferation Act of 1978, (P.L.95-242),

the Executive Branch is required to orovide the judgment previded fcr in Section 126 a.(1) of that law concerning nuclear export Ticense a::clications within 50 days of their receipt unless this per-iod is extended in accordance with that section.

Sixty days have elapsed since

ne Executive 3 ranch received the license acolications descrit-ad in the encicscres to this letter and additional time has been authcrized for censideration of these applications because, pursuant to the authority delecated to me by Ceoartmerit of State delegations of author"ty 140 and 140-1, the Department of State has determined i tc be in the national interest to allow such additional time.

With recard to :he license applications listed in Encict;ure 1, the Executive Branch is awaiting receipt of a letter from the gewernment of the recipient country providing necessary assurances that the proposed export will be subject to the terms and conditions of the Agreement for Cooperation with the US and that the proposed recipient is authorized to receive the material or facility described in the export rec.aest.

This

" assurance letter" is a longstanding requirement for exports.under US r

Agreements for Cooperation.

The export license applications described in Enclosure I involve significant quantities of highly enriched uranium.

They are currently being analyzed by the Executive Branch officials prior to beiing submitted, where necessary, to the President for his review.

The US "AIA Agreement does not previde f or certain US ric. hts of consent over the disc.osition of US-licensed fuel utilized in the KRSKO reactor.

Discussions are currently underway with Yugoslavia on these matters.

Regardinc. XSNM-1230, the US has previousiv. suc..clied fuel for a research reactor through the IAE.A; however, the related supplier agreement has expired.

It is our intention to conclude a new supply arrangement consistent with the NNPA and current US policy before taking any further action on this export.
