MOTION TO MODIFY RETURN DATE 0F SUBPOENA 0F CARL STOVER Upon application by Houston Lighting & Power Company and Texas Utilities Generating Company, e_t, al., this Board issued a subpoena duces tecum requiring t

the attendance of Carl Stover, C.H. Guernsey, Inc., of Oklahoma City, OK. at a deposition in this proceeding. A subpoena issued to the keeper of the records of C.H. Guernsey, Inc. was issued simultaneously.

The Staff is informed that both the deposition of Mr. Stover as well as the production of documents by C.H. Guernsey, Inc. (also involving Mr. Stover) are scheduled for July 24, 1979 in Oklahoma City.

Mr. Stover has been designated as a fact witness by the NRC Staff in this proceeding.

(He has also been so designited by the Department of Jus tice).

The Staff has just been apprised of other recent developments in another deposition in this proceeding which might impact materially on Mr. Stover's deposition. The Staff would like the opportunity tc review and analyze these developments prior to the deposition of its designated fact witness, Mr. Stover.

Accordingly, the Staff hereby moves thi:; licensing board, pursuant to 10 CFR 52.720(f) of the Commission's Rules of Practice to modify the return date of both 79083399,0

p the subpoena issued by this Board to Mr. Carl Stover and the subpoena to the keeper of records of C.H. Guernsey, Inc. be modified until a future date, to be mutually agreed upon by counsel for all interested parties, or failing that, as determined by this Board. A draft order to that effect is attached hereto.

The NT.C Staff has moved this licensing board that the return date of the subpoenas issued by this Board to Mr. Carl Stover, a designated fact witness of the NRC Staff in this proceeding, and the subpoena to the keeper of records of C.H. Guernsey, Inc. be mpdified from July 24, 1979 to a future date to be mutually agreed upon by counsel for all interested parties or as directed by this licensing board.
