e INTERACENCY PROGRAMMATIC AGREEMENT I Introduction This agreement defines the working relationships between the DOE and NRC associated with the reviews and certification ofl package designs used by DOE and its contractors for the shipment of radioactive materials. II Background The Transportation of Explosives Act (18 U.S.C. !ia 831-835), the Dangerous Cargo Act (R.S. 4472, as amended, 46 U.S. C.170), and Titic VI and a 902 (h) of the Federal Aviation Act of 1958 (49 U.S.C. 1421-1430 and 1472 (h)), authorized the U. S. Department of Transportation.(DOT) to regulate the transportation of explosives and other dangerous articles, including radioactive materials. The Atomic Energy Commission (AEC), under 42. U.S.C. Chapter 23, was authorized to license and regulate the receipt, possession, use and transfer of " byproduct material", " source material", and "special nucicar material'.'. The Energy j Reorganization Act of 1974 (P.L. 930438) abolished the AEC and created l the NRC and ERDA to replace the AEC. The Act resulted in NRC having license responsibilit'y for radioactive shipping packages in conjunction with the DOT. Under the provisions of the Department of Energy Reorganization Act (P.L. 95-91), August 4,1977, the DOE has assumed all" responsibilities i l of the former ERDA. i i 1 = Shipments of radioactive materials made by or under the direction or supervision of th'c DOE or the Department of Defense are exempted from 'l D0r ana NRC regu1atione in accoraance.1th the provisiens of 18 u.S.C. i G832(c). f 2 The DOE-NRC Memorandum of Understanding executed February 24, 1978, provides for interagency ennperatinn; and prnvides f,r DOE access tn h the NRC staf f and the Advis,ry Cnmmittee an React,r Safeguards (ACRS) for safety reviews and advice. Since b,th DOE and NRC are invnived with the shipment nf nuclear materials, E the review and interagency relationships and,responsJh.Llities related en apprnval of. package designs fnr shipment of such materials is required. e. III Definitions i Terms used in this agreement are defined in Code of Federal Regulations No. 49, Parts 100-200 inclusive and CFR 10, Part' 71, and are included herein by this reference. ~ l IV Relationships en other Interagency Agreements A. The NRC-DOT Memorandum of Understanding (MQU) identifies NRC and DOT roles and ' responsibilities asseciated with the licensing of radin-active material transportation activities in the enmmercial sector. DOE Requests for NRC Review DOE will evaluate package des (gns used by its contractnrs fnt offsite shipments nf fissile materials and of nther radinactive materials in quantitics exceeding type A limits. These evaluations will consider bnth DOT and NRC requirements. Based up,n DOE evaluation nf the suppnrting safety dncumentation DOE will issue a Certificate of Cnmpliance for each specific package design for DOE use. After. review and approval by the DOE staff, the DOE will forward i its findings, the safety analysis report, and the DOE Certificate of 1 Compliance on the package to the NRC with a formal request. for an l independent review. 5 Upon receipt of the formal DOE request, NRC will schedule the review, nntify DOE of the expected cnmpletinn date, and establish a d,cket file. o NRC will perform the safety review in accordance with prncedures established for a. licensee application, will formally advise DOE of its findings and conclusigns, if DOE requests;will issue an NRC an Certification nf Compliance, or a specific DOE package if no nutstanding technical nr safety problems exist. The NRC certificates w,uld be used by commercial carriers nr licensee private vehicles. As part of their review NRC m.ay request acoltinnal infnrmation pertinent to the specific package under, review. E DOE will evaluat' st ch requests, and if the information is n,t readily available, will fntmally notify NRC of the estimated availability date'. Unresnived problems will be escalated thrnugh the chain-nf-cnmmand in each agency, simultanenusly, until resnlutinn is achieved. Agreement between agencies, at any comparable icvel in that chain of enemand, shall constitute problem ra ' atinn. i i /. 8 VII Limitatinn A. Nothing in this agreement abrngates agency statutory auth',rities, nr to af fect the auth-rity nf the Natinnal Transpnrtation Safety Board which is independent nf DOT, NRC, and DOE or any nther interagency agreements relating to transportatinn research develnpment and demnnstration e [ (RD&D) activities. l B. Packaging of nuclear weapons and radinactive c,mponents therenf are specifically excluded from this ai;reement. VIII Agreement This agreement is effective upon sign' tur,e nf the tw, agencies and will a be impicmented by both agencies.
