AGREEMENT WITH EQUAL EMPLOYMENT OPPCRTUNITY COMMISSION TO CONDUCT THE INVESTIGATION OF INDIVIDUAL COMPLAINTS OF DISCRIMINATION ACCEPTED IN NRC On July 24, 1979, I spoke with the Commissioners regarding a Memorandum of Understanding (MOU) with the Equal Employment Opportunity Commission (EEOC) proposing that EE0C conduct the bulk of our individual EE0 complaint investi-gations. As background, staffing problems in OIA initiated a request by OIA that EE0C consider conducting our EE0 investigations. The EE0C then pro-posed the MOV covering a Pilot Program by EEOC to test new techniques of investigation and conciliation for the Federal sector.
Five other Agencies have executed the MOU's and are a part of this Pilot 2 Program.
Following verbal approval by the Commissioners of EEOC's proposal, and clearance with the Union (NTEU), I signed the MOU on July 25, 1979. DIA, OEE0 and ELD have concurred in the action.
The investigations will be conducted by EE0C cn a reimbursable basis. The MOU covers a backlog of three cases to be investigated and all new cases (with the exception of age and handicap cases) which the Agency submits to EEOC through September 30, 1979.
The Agency has the option to renegotiate with EEOC at the termination of the current agreement.
As we. discussed, for a number of reasons the arrangement with EEOC will be beneficial for the Agency. OIA's manpower requirements previously expended on EE0 investigations will be relieved. Moreover, from a strict dollar and cents point of view, utilizing EEOC's investigative services should prove 79082703 N,
, cost effective. 'Most importantly, however, I believe the Agency's EE0 objec-tives will be better served by the independent investigation and more expedi-tious processing of complaints promised by the EEOC.
