- RECC:O'Ei;DED CRDER TO SHCW CAUSE Enclosed is a copy of a draft Order to Shcw Cause that was prepared by the Region'III (Chicaco) office at ycur recuest.
After raviewing the order and its enforcement basis, and discussion' with Mr. A. 3. Davis of Region III, we do not agree that the order be issued by IE.
Thare are several bases for this:
(1) the ncn-enforceable character of the enfercement basis, quoted in part on page 2 of the order; (2) the " iffy" nature of the health and safety cencern expressed on page 3 of the order, and (3) the failure to see any further action required in this order (other than specificity) that was not included in Mr.*Dircks' order of March 20, 1979.
If we believe it necessary that i;ECO pump and dispose of the water from the sumps of the trenches, we can 'do that regardless of the precedures in their manual.
However, an ordering action such as 'this shculd originate in HMSS, the licensing office, because 1: icpeses a specific requirement on the licensee.
