MOTION BY RESPONDENT GULF STATES UTILITIES COMPANY FOR LEAVE TO FILE A REPLY BRIEF Pursuant to 10 C.F.R.
S2.730 (c), Respondent Gulf States Utilities Company
(" Gulf States") hereby requests leave to file a brief in response to the answers filed by the Department of Justice and the Public Utilities Board of the City of Brownsville, Texas ("Brownsville") to Gulf States' motion and supplemental motion for a protective order.
In the interest of avoiding unnecessary delay, Gulf States will file its reply brief within five business days after receiving per-mission to file.
The short period of time requested will not substantially delay the proceedings and will enable Gulf States to correct the erroneous assertions and inferences of the answering parties.
Specifically, both Justice and Brownsville attribute to Gulf States a lack of good faith in responding to the subpoena.
The reply which Gulf States proposes to submit would demonstrate 790607osq its good faith in complying with the subpoena issued by the Atomic Safety and Licensing Board
(" Board"), by explaining the procedure by which documents have been assembled for produc-tion, the efforts involved, the natur, and bulk of the docu-ments to be produced, and the cost attributable to these efforts.
Since the documents had not been completely gathered until the submission by Gulf States of its Motion for a Protective Order, it simply was not possible to provide an

accurate and contemporaneous discu:sion of the efforts in-volved.-1/
Moreover, while Brownsville has been unable to cite any controlling precedent whatever to disallow the reim-bursement of production costs in their entirety, its 55 page discussion on areas of law to which it analogizes requires further discussion to make important distinctions.
Also, Gulf States would like an opportunity to clarify its position with regard to those documents it possesses which have been generated by Houston Lighting & Power ("HL&P") within the context of HL&P's settlement negotiations.
Gulf States wishes to clarify its intentions with regard to its proposed protective
- order, i.e.,
that Gulf States merely intends to avoid 1,/
On the one hand, Brownsville criticizes Gulf States for proceeding forthwith to comply with the subpoena demands for documents regardless of burdensomeness, thereby de-ferring the issue of reimbursement for costs incurred until later.
Elsewhere, Brownsville argues that Gulf States has insufficiently documented its costs and expenses and is therefore not entitled to any reimbursement whatsoever.
Obviously, this " heads I win, tails you lose" argument warrants further discussion.

In sum, Gulf States simply requests a brief period within which to clarify its status as a disinterested third party that wishes to cooperate fully with the Licensing Board and the parties by complying with the Board's subpoena, while at the same time protecting its right to protect confidential informa-tion and to recoup costs and expenses or a reasonable portion thereof for its document production.
