Dear Mr. Chairman:
Enclosed for the information of the Subcommittee on Energy and the Environment is a notice of rule making adopting amendments to 10 CFR Part 140, " Financial Protection Requirements and Indemnity Agreements,"
which increases the amount of financial protection required of licensees of power reactors with a rated capacity of 100 MW(e) or more and certain other licensees.
The two nuclear Energy liability insurance pools have notified the Comnission that effective January 9,1979, the maximum available primary liability insurance would be increased from $140 million to $1f 0 million.
The enclosed notice of rule making reflects this increase and as to be effective on May 1,1979, so as both to afford licensees reascnable opportunity for obtaining the additional insurance and to allow the Connission time to modify its indemnity agreements.
Also, enclosed for your information is a copy of a public announcement that we plan to issue in the next few days on this matter.
