Dear Mr. Cochran:
This is in further response to your letter dated July 20, 1978, in which you requested, pursuant to the Freedom of Information Act, all the minutes, memoranda, and any other information prepared for, discussed at, or in any way related to the NRC/D0E Liaison Board meetings.
In our response dated August 22, 1978, you were advised that some documents subject to your request were being referred to the Department of Energy (DOE) and that the NRC was consulting with DOE regarding their disclosure. The documents cleared for release by DOE are listed on Appendix A and are being placed in the Public Document Room (PDR) located at 1717 H Street, N.W., Washington, DC.
A portion of document 1 on Appendix B has been classified pursuant to Executive Order 12065 and is being withheld from public disclosure pursuant to exemption (1) of the Freedom of Information Act (5 U.S.C.
552(b)(1)) and 10 CFR 709.9(a)(1) and 709.11 of the Department of Energy's regulations.
A portion of document 4 and documents 2, 3, 6 and 7 on Appendix B are drafts or other documents containing advice, opinions, and recommendations of the staff and are being withheld from public disclosure pursuant to exemption (5) of the Freedom of Information Act (5 U.S.C. 552(b)(5)) and 10 CFR 709.9(a)(5) of the Department of Energy's regulations.
Portions of document 5 on Appendix B are drafts or other documents containing advice, opinions, and recommendations of the staff and are being withheld from public disclosure pursuant to exemption (5) of the Freedom of Information Act (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations.
The non-exempt portions of the documents listed on Appendix B are being placed in the PDR.

Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest.
The person responsible for the denial of the withheld portion of document 1 on Appendix B is Mr. John A. Griffin, Director, Office of Classification, Department of Energy.
The person responsible for the denial of the withheld portion of document 4 and the denial of documcats 2, 3, 6 and 7 on Appendix B is Mr. Harvey E. Lyon, Director, Office of Safeguards and Security, Department of Energy.
The persor6 responsible for the denial of the withheld portions of document 5 Are the undersioned and Mr. William J. Dircks, Director, Office of Nut! ear Material Safety and Safeguards.
The denial by Mr. Dircks and myself may be appealed to the Executive Director for Operations within 30 days from the receipt of this letter.
Any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision." The denials by Messrs.
Griffin and Lyon may be appealed to the DOE Appeal Panel, mailed to the Freedom of Information Office, DOE Headquarters, Washington, DC 20545, within 60 days after receipt of this letter.
Both the appeal letter and envelope must clearly be marked " Freedom of Information Appeal."
