Dear Mr. Utley:

This is in response to your letter of March 12, 1979, regarding the proposed Greene County Nuclear power Plant, Docket No. 50-549.

Based on discussions at the meeting between Mr. Singh Bajwa (NRC), Ms. Amy Schlagel, and Mr. Gorden E. Tennenbaum of your staff, we are of the opinior. that the intent of our letter of February 9,1979 was misconstrued. We trust that this letter and attachments will resolve any procedural issues.

In accordance with the provisions of Section 106 of the National Historic Preservation Act of 1966 and Council's regulations for the " Protection of Histeric and Cultural Properties" (36 CFR Part 800), we hereby request Council comments under Section 106 of the Act and Section 2(b) of the Executive Order, specifically 36 CFR Part 800.6d.

The NRC staff has prepared a Final Environmental Statement on the proposed project which may receive its Construction Permit by February 2,1980.

The hearirigs are scheduled to start on April 2,1979 in Albany, New York and are expected to continue for approximately three to four months.

In accordance with 36 CFR 800.13b the staff's FES should serve the purpose of a preliminary case report which is also supplemented by the testimonies of (1) New York State Parks and Recreation (State Historic Preservation Officer), (2) Columbia County Historical Society, Friends of Olana, Greene County, the Towr and Village of Catskill and Town and Village of Athens, The Hudson River Conservation Society and Hudson River Sloop Clearwater, (3) New York Department of Public Service, and (4) NRC_ Draft FES Volume III (see Enclosure 1).

The NRC staff used the criteria established in 36 CFR 800.3a and b exten-sively in its analysis, determined adverse effects of the proposed project in Section 5.7 of the FES in accordance with 36 CFR 800.4d, and further recommended alternatives to mitigate the adverse effects (see Summary and Conclusions, Part 7, of the FES).

Utley MAR 2 21979 In accordance with 36 CFR 800.6b(3) the NRC staff suggests that there is no need for a public information meeting since several such meetings were held previously by the State of New York, Department of Public Service and the NRC in preparation of the FES and the testimonies. Also public hearings have been in progress since February 1977, in which local citizens and local and state governments have participated extensively.

In your review and commenting process, we would like you to consider from the aspect of 36 CFR 800, the following major issues:

(1) Whether or not the plant as proposed by PASNY should be constructed at the Cementon site; (2) If not, whether or not the plant with the mitigation plan as proposed by the NRC staff should be constructed at the Cementon site; (3) If not, whether or not the plant should be constructed with any viable mitigation plan, and if the answer is yes, what that plan should be; if the answer is no, why not.

Please direct your comments specifically to the issues stated above.

The NRC is working under a tight schedule and therefore requests your response at the earliest possible date.
