MDICRMiDUM This ce=orarium is in response to the Atomic Safety and Licensing Appeal Board's Memorardum and Order (AIAB 509) of December 1,1978 (Docketed US:aC December 4, 1078) which sought, first, further clarification of the extent to which parties concerned about radon emissions are dissatisfied with Perkins insofar as it deals with rates of radon release or levels of radon concentration, and secondly, if Perkins is accurate on e=ission rates and concentration levels, to exa-d e the -

Licensing Board's de -indm m theory.

The Sassafras audubon Society, 'in its recuest to the Appeals Soard to be a Friend of the Court (amicus curiae) in Hearing on radon emissions and health effects re-sulting therefrom as pertaining to Marble H4'1 Nuclear Units 1 and 2, (July 23, 1978), cited Perkins as inco=plete, and inaccurate in sc e instances, and asked that the GZIS on -il' tailings which the NRC was preparing be made available to interested parties prior to receiving additional evidence and testi=crif on radon.

The GEIS should provide:

1) data and general infomation sufficient for a full and open discussien of radon as it relates to the + dy ard -d" 4 r.g of uranius; ard produce :
2) evaluation and co==ent from a broad sector of the public, and government and their agencies, pertinent to decision-caking on uranium cine and d

operations and decc dssiering recuire=er.ts; on stardards ard criteria d tail-for stabilization, surveillance, and m'-tenance, of uranium ings; on establishment of finnecial responsibility (including costs of radon-induced health effects) and institutional arrangements fo- - 'dable, long-tem radon-e=ission =anagement.

Various " positions" ard " attitudes" of the Nuclear Regulatory Co " esien, :aC staff, Licensing and appeal Boards, etc., regarding radon (as it applies to the mining and dd g of uranium) are unacceptable to us and a para =ount reason for asking that the GEIS be issued as soon as possible to provice a base for 7903050t94

2 broad public input into resolving of issues for which the Arpeals Board is seek-ing " clarification" in AI43 509 J. B. Martin and H. J. Miller (US: IFS staff) in the recent article: Generic Errriron-mental !=cact Statement on U.S. Uranium Mii w Industrr (1978) excreased the ob-jective of rehabilitating t'41"v7s piles through burial and/or so:.1 cover to a certain radon-ecission level which would =ake then ready "for the ages" without further responsibility.

This "out-of-sight, out-of-mi rd", "let George do it" attitude is, perhaps, best expressed in the Perkins Decision, pages 16-17:

"It is not apparent that piles that =eet present :24 standards wi n be eroded in a =atter of a few hundred or a few thousard years. Further= ore if there are people around to breath the radon, those people can readily repair any da: age".

A " walk-away-after-fixing" position is basically unscuri, no =atter how well-designed ard executed the tailir.gs piles rehabilitation envisioned by the T4C.

Cli=atic changes which have occurred in the United States since the last glacia-tion (a series of plirrial-interplunal periods etc with =arked regional changes) attest to the need for surveillance and maintenance within even a short time fra=e.

We were told several months ago that the GEIS on ~4'1 tad'ings etc was expected to be ready early in 1979 The Martin and M4'ler article on the GEIS =entions its issuance in several =onths ard several conths have passed. ahat is the ex-pected publication date at this ti=e? Je ask to be placed on the -ad F .g list.

This me=orandum has been sent to the Marble F417 service list as enclosed. If we have failed to serve the entire list, we would appreciate receiving the com-plete up-to-date list in order to complete the requirement.
