Dear Mr. Zielinski:
This is in response to your letter of December 28, 1978 expressing your concern about the progress of the joint Federal-State proceedings on the Power Authority of the State of New York's proposed Greene County Nuclear Plant.
I understand that subsequent to your letter, our respective staffs have held several meetings on this subject, and are in frequent communication.
We recogr,ize the importance of amendments to Article VIII of the New York Public Service Law and statutory deadline with which you have to comply. As you have stated in your letter, the joint hearing board is developing a schedule that will be consistent with the recent Article VIII amendments.
I also understand that the New York State hearing examiners and the presiding Atomic Safety and Licensing Board have issued an order which requires that the testimony of the respective staffs be filed by February 9, 1979. The NRC staff is doing its utmost to publish the Final Environmental Statement at the earliest possible time, and I am quite confident that the staff will be able to meet this date.
We share your deep concern for preserving the joint protocol, and you can be assured that the staff will make every effort to maintain its viability.
