3 Gentlemen:
This is to inform you, in i:ccordance with the requirements of the Nuclear tion-Proliferation Act, that NRC has not completed licensing action on the below listed applications for the export of components to West Germany which were received by NRC on November 3,1972:
Number XCOMC099 XCOM00100 XCOM00101 XCOM00102 We are unable to issue licenses on these export requests because they do not meet criterion 3 of Section 110.42(b) of our licensing regula-tions.
Specifically, criterion 3 states that "no such equipment or material will be retrcnsferred without the prior approval of the United States."
To neet this requirement, the Department of State has contacted the West German Government with respect to obtaining a generic assurance that no retransfers will be permitted without US approval.
This assurance has not yet been received. We have taken steps, however, to act expeditiously on your license applications upon receipt of the assurance.
