This office has received a copy of your October 20, 1978 application for amendment to Facility Licenses DPR-21 and DPR-65 which you filed with the Office of fluclear Reactor Regulation.
The application relates to proposed revisions to Environmental Technical Specifications and to Safety Technical Specifications for Millstone Unit flos.1 and 2.
In your application you stated that no amendment fees are applicable because the changes constitute only a restructuring of the specifications which will not involve any new issues to be considered in a safety evaluation, and will resolve the erroneous nature of the conflict between the A and B Specifications.
Footnote 2 of Section 170.22 exempts certain types of license amendments from fees (e.g., those in fee Classes I, II and III which result from Commission request provided that they have only minor safety signifi-cance, are to simplify or clarify the license or Technical Specifications and are being issued for the convenience of the Commission).
Although your application is to resolve conflict between the'A and B portions of the Technical Specifications, it does not meet the criteria of Footnote 2 because the amendments were not requested of you by NRC nor are they for the convenience of the Commission.
We have determined from our preliminary review that the requested amendments involve a Class III ($4,000) for Unit flo.1 because they will require consideration and resolution of the environmental conflict between the Appendices A and B Specifications, and a Class I ($400) for Unit No. 2 as a duplicate amendment.
Consequently, you should forward fees totalling $4,400 promptly to this office.
Fees are payable to the U.S. Nuclear Regulatory Commission by check, draft, or money order.
