Dear Mr. Seidle:

LP&L's response to the item of noncompliance identified in the subject report is given below:

Failure to Follow Contract Specification Provisions Related to Fire Prevention Criterion V of Appendix B to 10 CFR 50 requires that activiites affecting quality shall be accomplished in accordance with pre-scribed instructions, procedures and drawings.

Section D-7 of contract W3-NY-16, " Erection of Main and Miscella-neous Structural Steel and Performance of Related Work," applicable to American Bridge and si ilar restrictions in other contracts applicable to other construction contractors preclude the use of wood and other flammable materials within the reactor containment unless the wood has been treated with-a flame retardant.

Contrary to the above:

1. On September 7, 1976, it was observed: that temporary covers installed on two fan / cooler units stored within the contain-ment structure, were fabricated from plywood and plastic sheeting not identified as flame retardant. Subsequent dis-cussions with LP&L and Ebasco personnel could not confirm that the temporary covers were flame retardant.

2. It was also observed on September 7, 1978, that wooden plank-ing, being utilized as temporary scaffolding by American Bridge within the containment, was not identified as flame retardant wood. Licensee and contractor investigation confirmed that the planking was not treated for fire retardancy.

(1) Correct,1ve steps.taken and the results achieved:

The temporary covers installed on the two fan / cooler units were promptly removed. An inspection of the Fuel Handling Building, Reactor Containment Building, and Reactor Auxiliary Building was con-ducted and verified that no other combustible material was present.

All non-fire retardant planks have been removed from the Reactor Con-tainment Building. Prior to removal of the planking, American Bridge instituted a fire watch when there was cutting or burning directly over an area where the non-fire retardant planking was located. Work was allowed to proceed on this basis only after a test was conducted at the Waterford site by American Bridge, Ebasco and LP&L personnel which determined that the placking was actually fire retardant even though-the material was not tr During the tesh heat was applied over a one square foot area of y.ank for five minutes using en acetylene cutting torch. The plank charred with the direct flame on it but upon removal of the direct flame, there was no additional burning.

(2) Corrective steps taken to avoid further noncompliance:

Site contractors have been reminded in writing of contractual require-ments which restrict 'the use of wood or other cumbustible materials on site.

Inspections are being conducted on a daily basis to assure that any combustible material that inadvertently enters the nuclear island is promptly removed.
