This is the February, 1979 report of the Public Utilities Board of the City of Brownsville, Texas

( "Brownsv ille " ) concerning its progress in completing discovery in the above-captioned proceeding.

During the month, Brownsville continued its review of d iscovery , testimony and hearing transcripts from the other related cases.

Brownsville's Washington counsel today received Central Power & Light Company's Responses and Objections to the

" Initial Interrogatories to and First Request for Production of Documents by Central Power & Light Company from the Public Utilities Board of the City of Brownsville, Texas" served by Brownsville en January 3, 1979. In addition, on February 23, 1979, Brownsville representatives started their review of documents being made available by CP&L in Corpus Christi, Texas, in response to Brownsville 's dccument request.

Brownsville has also received the Responses of City Public Service Board of San Antonio to Brownsville's Interrogatories and Requests for Documents. San Antonio has agreed to make documents available for inspection, and Brownsville representatives have arranged with San Antonio to review and select documents for copying during the week of the 19th of March, 1979. Brownsville has similarly arranged to review documents responsive to its Initial Interrogatories and Request for Documents by the City of Austin in Austin this week.

While Brownsville has received "TUGCO's Cbjections and Motion for Protective Orders with Regard to Brownsville 's Interrogatories and Document Requests" dated March 2, 1979, Brownsville still awaits receipt of the discovery documents produced in West Texas Utilities Co. et al. v. Texas Electri_c Service Co. , Case No. CA3-76-033F (N.D. Texas, Dallas Div.),

which Brownsville's representative designated for copying in early January, 1979. Brownsville hopes these documents arrive soon.

During February, Brownsville continued to work infor-mally with Central Power & Light Company and other parties to arrange for third party discovery from Air Products and Chemicals, Inc., E. I. DuPont de Nemours & Co., Monsanto Company, PPG Industries, Inc., and Union Carbide Corporation.

The parties believe they may have worked out satisfactory arrangements among themselves to obtain the information they need. Should this arrangement not prove satisfactory, however, Brownsville has reserved its right to seek the issuance of s 'bpoenas. Brownsville has obtained a subpoena for the production of documents by Gulf States Utilities Company, issued by the Licensing Board on February 26, 1979, which it has arranged to have served as soon as possible. In the meantime, however, Brownsville is attempting to arrange informally with Gulf States to obtain the information it needs.

On February 26, 1979, Brownsville received Central Power

& Light Company's First Set of Interrogatories To and Request for Production of Documents from the Public Utilities Board of the City of Brownsville, Texas. As reflected in the attached letter, counsel for Central Power & Light Company

and counsel for Brownsville have agreed that responses to interrogatories and production of dccuments shall be made thirty days following the date of service, plus the addi-tional time allowed for service by mail. Brownsville has s tarted organizing and preparing its response to CP&L's interrogatories and request for documents.
