h Appendix A NOTICE OF VIOLATION Nuclear Engineering Company, Inc.

License No. 13-10042-01 Based on the results of an NRC inspection conducted on May 12, 1980, it appears that one of your activities was not conducted in full com-pliance with NRC regulation as indicated below. This item is in severity category three.

10 CFR 71.5, " Transportation of licensed material" states "no licensee shall transport any licensed material outside of the con-fines of his plant or other place of use, or deliver any licensed material to a carrier for transport, unless the licensee complies with the applicable requirements of the regulations appropriate to the mode of transport, of the Department of Transportation in 49 CFR Parts 170-189.

49 CFR 173 392(c)(1) states in part that LSA materials transported in sole use transport vehicles must be packed in strong, tight packages so that there will be no leakage of radioactive materials.

Contrary to the above, on May 12, 1980, a drum of LSA material off loaded from a sole use trailer at the Richland, Washington, disposal site was observed not to be a strong tight package in that it had a two inch gash in its side, soosno go
