DEPARTMENT OF JUSTICE MOTION FOR EXTENSION OF TIME 1.
Pursuant to 10 C.F.R. 52.711 of the Nuclear Regulatory Commission's ("NRC") Rules of Practice, the Department of Justice (" Department") hereby moves for an extension of time to and including August 7, 1980 within which to file its response to the " Petition of the Texas Border Cooperatives for Leave to Intervene Out of Time" (" Petition").

On August 1, 1980, the Texas Border Cooperatives served their Petition on the Department by hand.
Under 10 C.F.R. 52.714(c) and 10 C.F.R. 52.710 the Department would have until August 6, 1980, to respond to the Petition of the Texas Border Cooperatives.

The Department has been engaged in the preparation of its proposed licensing conditions for the South Texas Project and the Comanche Peak Nuclear Station and it has been making 800811'O f2 f d
substantial efforts to comply with the Atomic Safety and Licensing Board's "Prehearing Conference Order, and Notice of Final Prehearing Conference" of July 17, 1980.
As a result of these efforts, the Department is presently unable to file a response to the Texas Border Cooperatives Petition within the time period set down by the NRC Rules of Practice.
WilEREFORE, the Department respectfully requests a single additional day within which to file its response to the Texas Border Cooperatives' Petition.
