Dear Mr. Neuhauser:

We were sorry to learn from you.~ letter of August 15, 1979, of the Georgia Conservency belief that the NRC's present policy for the ap;roval of shipping routes for licensed nuclear materials is inadequate.

Your letter is particularly timely because a considerable regulatory effort is under way to refine newly issued regulations and related guidance (both enclosed) for the protection of spent fuel during transport. The regulation and guidance set forth current NRC policy for the approval of ports and sub-sequent routes.

Public corments have been solicited concerning the regulations and guidance. The public conment period for regulations just ended and we are analyzing the conments to determine the kinds of changes, if any, that are needed in the regulation.

The public conrnent process provides_ an excellent opportunity for organiaations such as the Georgia Conservancy to influence the actual rules and criteria that will govern' spent fuel shipments.

Althorgh the formal conment period has ended, we would nonetheless welcome your views en how the regulation and guidance should be changed to better reflect the public interest.

Your letter also suggests the need for a ccmprehensive study of potential ports of entry for spent fuel imports.

Our current practice with respect to approval of ports-of-entry and subsequent routes for spent fuel import shipcents is to collect the kinds of information (other than economic) suggested in your letter and use the information in subsequent deteminations concerning adequacy of ports-of-entry and routes.

The information is not, however, in the fom of a comprehensive study as suggested in your letter.

He will keep your suggestion in nind as we analyze the public ccments and will undertake such a stu(v if it0}r it appears appropriate.
