Reference is made to your letter 79ESG-4754, dated May 10, 1979, in which you requested a temporary exception to certain requirements of 10 CFR 73.60(a)(1) to permit removal of high-enrichment uranium fuel plates from the Material Access Area for fluoroscopic examination at another facility.

In reviewing this request we have determined that the proposed activity also would not be in accordance with the requirements of License Condition 2.4 of Materials and Plant Protection Ameadment MPP-1 to your License No.

SNM-21. However, we have concluded that the measures proposed in your letter provide adequate material control and physical protection for this material.

Accordingly, we are amending Sections 2 and 9 of Materials and Plant Pro-tection Amendment MPP-1 to your License No, SNM-21, effective immediately, by revising License Condition 2.4.1 and adding License Condition 9.A.4.6 as contained in the enclosures to this letter.

2.4.1 Uranium fuel plates may be used for offsite testing of equipment during the period May 21, 1979 to July 21, 1979 or until the equipment testing is completa, whichever is sooner.

This exception is granted on the basis that the ',1censee must fulfill all of the commitments reflected in his letter, 79 ESG-4754 dated May 10, 1979.

9.A.4.6 The licensee is granted a limited exception to the requirement of 10 CFR 73.60(a)(1), which stipulates that SNM shall be processed only in a material access area, to allow the X-ray fluoroscopic examination of fuel plate's outside the licensee's material access area during the period May 21, 1979 to July 21, 1979, or until the fuel plate examinations are completed, whichever is sooner.

This exception is granted pro-vided that in conducting the X-ray fluoroscopic examinations the licensee fulfills all of the commit-ments proposed in his letter, 79 ESG-4754, dated May 10, 1979.
