Dear Mr. Bell:
Your letter of March 24, 1979, to Chainnan Hendrie, regarding the proposed Wolf Creek fluclear Plant at Burlington, Kansas was referred to me for re-sponse because it raises procedural and legal questions about which I am most familiar.
In your letter you have requested a hearing on what you understand to be a possible sale of a 17% interest in the Wolf Creek Plant to certain rural electric cooperatives.
It is our understanding that pursuant to a settle-ment agreement in a 1976 NRC antitrust proceeding the Kansas Electric Cooperatives, Inc. was to acquire a 17% interest in the Wolf Creek Plant.
To the best of our knowledge this matter is still being negotiated since no application has been received by the NRC for an amendment of the NRC license for the Wolf Creek Plant to reflect a change of ownership.
No change of ownership of the Wolf Creek Plant can be accomplished without NRC approval.
If an application for a change in ownership is received by the NRC, an appropriate notice will be published by the NRC. The notice will provide an opportunity for members of the public to request a hearing on the pro-posed amendment.
I will arrange for you to receive a copy of that notice, if an application is received.
You may then follow the procedures specified in the notice to request a hearing.
At this time your request for a hearing is considered to be premature.
