Gentlemen:

As you know from previous conversations, based on our January 17, 1978, letter on the ANO-1 docket documenting NRC staff instructions regarding the reportability, under degraded mode reporting requirements, of inoperable equipment for which a report is required if the inoperability is extended beyond a specified time period (with no operating restrictions),

we determined that a previous failure to perform the surveillance

. requirements of Technical Specification 4.3.3.3.1 within the specified time interval 25% was no~. reportable because the surveillance had been performed before the specified interval + 25% + the 30 days allowed by Technical Specification 3.3.3.3.a.

We now understand, based on a subsequent phone conversation with Messrs. Engle and Brinkman on February 8, 1979, that the previously documented staff instructions are no longer valid.

We are therefore filing the subject report now based on Mr. Brinknan's ruling that, even though no action is required unless the equipment is inoperable for more than 30 days, operation with the equipment inoperable for any period of time is operation in a degraded mode.

Mr. Engle will be contacting the ANO-1 NRC project nanager to request an administrative change to the ANO-1 technical specifications properly clarifying the intent of the appropriate Fire Protection Technical Specifications given the change in the staff's instructions.

This clarification will be consistent with conversations that we had with the staff prior to the Janusry 17, 197S, letter in which we requested but were denied such clarification.
