JAN 2 4 B79 MEMORANDUM TO THE FILE STAFF CONCLUSIONS REGARDING LICENSE TO EXPORT COMPONENTS TOBELGIUM(XCOM0014)
In July 1978, National Forge Company applied for a license to export components to Belgium for use in the Tihange II reactor.
In a letter dated January 19, 1979, the St te Department informed NRC that it is the view of the Executive Branch that Belgium meets the three export licensing criteria under 5110.42(b) of Part 110 for the export of nuclear equipment. The first two criteria of 5110.42(b), (1) application of IAEA safeguards to the equipment and (2) no nuclear explosive use of the equipment are met by Belgium's adherence to the NPT. The third criterion, no retransfer of equipment without prior U.S. approvai, is met by Belgium as confinned in a letter from the Foreign Ministry of Belgium. The staff agrees that the three criteria are met.
As required by Section 109(b) of the Atomic Energy Act and 5110.44(a)(1)(ii) of Part 110, the staff has concluded that the proposed export would not be inimical to the conmon defense and security of the United States or constitute an unreasonable risk to public health and safety.
