This is to inform you, in accordance with the requirements of the Nuclear Non-Proliferation Act, that NRC has not completed licensing action on the below listed component applications which were received by NRC in November 1978.

Number Country of Destination XCOM0109 Netherlands XCOM0ll3 France XCOM0ll4 West Germany XCOM0ll5 Belgium We are unable to issue licenses on these export requests bt.cause they do not meet criterion 3 of Section 110.42(b) of our licensing regula-tions. Specifically, criterion 3 states that "no such equipment or material will be retransferred without the prior approval of the United S ta tes. "

To meet this requirement, the Department of State has contacted the countries involved with respect to obtaining generic assurances that no retransfers will be permitted without US approval.

These assurances have not yet been received.

We have taken steps, however, to act expeditiously on your license applications upon receipt of the assurances.
